The RecumbentPDX (“RPDX”) exterior bulletin board is private space (“Private Space”) that may be used only with our prior written authorization. Posted items without  prior written authorization are unauthorized material (“Unauthorized Material”).

By posting Unauthorized Material to Private Space, the entity featured on the Unauthorized Material (“Advertiser”) agrees to pay the RPDX daily advertising rate of $15.00 (“Daily Rate”). The Daily Rate remains in effect without exception until the Unauthorized Material is removed.

RPDX will make best efforts to inform the Advertiser -by public email address, if one is available- of Advertiser’s liability for daily charges.

• RPDX’s inability or failure to notify Advertiser does not relieve Advertiser of its responsibility under this agreement.
• Advertiser’s inability or failure to receive notification does not relieve Advertiser of its responsibility under this agreement.
• Advertiser’s use of subcontractors or third parties to post Unauthorized Material to Private Space does not relieve Advertiser of its responsibility under this agreement

Advertiser is responsible for removing and properly-disposing of Unauthorized Material. Advertiser will notify RPDX by email (info@recumbentpdx.com) that Unauthorized Material has been removed and will receive an email response from RPDX confirming removal.  RPDX will remove Unauthorized Material from our private space after 90 days.  If RPDX removes Unauthorized Material, in addition to Daily Rate, Advertiser agrees to a $50.00 removal and disposal fee (“Disposal Fee”).          

Scheduled invoices will be issued to Advertiser’s publc email address, if one is available. 

• RPDX’s inability or failure to issue an invoice to Advertiser does not relieve Advertiser of its responsibility under this agreement.
• Advertiser’s inability or failure to receive invoice does not relieve Advertiser of its responsibility under this agreement.

Advertiser is responsible for all fees required to collect including, but not limited to, RPDX attorneys’ fees, court costs, process serving costs
